Information requested

Any and all correspondence between the Scottish Government and Scottish Water/Scottish Water Horrisons and The Highland Council regarding the following:

  • The Arderseir Waste Water Treament Plant Development

  • The "Bund" at Ardersier

  • Community / Resident Issues

  • Landownership considerations in connection with the laying of the new pipeline from Trornagrain to the Ardersier Waste Water Treatment Plant

The timeframe for my requests is from April 1st 2017 to the 20th of June 2017.

I enclose a copy of all of the information you requested.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections s.38(1)(b) (Personal information relating to a third party) and s.36(1) (Confidentiality in legal proceedings (covers legal advice)) of FOISA applies to that information. The reasons why these exemptions applies are explained in the Annex to this email.

Reasons for not providing information

An exemption under section s.38(1) of FOISA applies to some of the information you have requested. Personal information relating to third parties has been redacted in all relevant documents.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

An exemption under section s.36(1) of FOISA applies to some of the information you have requested. 5 documents have been withheld as they are considered private and confidential in relation to legal proceedings.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption.
