Information relating to requests received by the Scottish Government from 1 April 2010 onwards, detailed in the attached spreadsheet.
I enclose a copy of most of the information you requested in the format you asked for.
With regards to information on the outcome of appeals to the Scottish Information Commissioner, most of the information you have requested is on the Scottish Information Commissioner's website and the Scottish Government FOI Annual Reports.
Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the websites listed, then please contact me again and I will send you a paper copy.
With regards to figures requested under 3(b) and 4(b), while our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600. Although numbers of cases answered on time could be provided for 1(b) and 2(b), providing figures under the parameters of questions 3 and 4 required a different search to that run for questions 1 and 2.
This search does not allow us to determine how many requests falling within the parameters of 3 and 4 were answered on time. In order to determine this information, we would therefore need to check each request falling with the parameters and examine whether each individual request had been answered on time. Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.
You may, however, wish to consider reducing the scope of your request in order that the costs can be brought below £600. Although we cannot provide figures for the number of requests answered on time/late for the parameters of questions 3 and 4, we can provide figures for requests made under requester types of Media, Researcher and/or Elected Representative. You may also find it helpful to look at the Scottish Information Commissioner's 'Tips for requesting information under FOI and the EIRs' on her website.
