Nicola Sturgeon meeting Michel Barnier in Brussels: FOI review

Information request and response under the Freedom of Information (Scotland) Act 2002.

FOI reference: FOI/17/01647
Date received: 10 August 2017
Date responded: 28 August 2017

Information requested

Further to the communication of 10th August 2017 I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for a full copy of the minutes of the meeting between the First Minister of Scotland, Nicola Sturgeon MSP and the European Union (EU) Chief Negotiator Michel Barnier in Brussels on the 13th of July 2017.

Response

I have concluded that the original decision should be confirmed, with modifications.

The original response to your request withheld the full minutes of the meeting between the First Minister of Scotland, Nicola Sturgeon MSP and the European Union (EU) Chief Negotiator Michel Barnier in Brussels on the 13th of July 2017, under the exemptions at sections 32(1)(a)(i) (international relations) and 38(1)(b) (personal information) of FOISA. I have found that, while these exemptions were correctly applied to much of the information in the minutes for the reasons set out in our response letter of 31 July, they should not have been applied to all of the information. Accordingly, I enclose a copy of the minutes from which the exempt information has been redacted. Under FOI you are able to request information, not specific documents. The link provided below includes the main information that we can provide after applying the exemption and public interest test.
