You asked for:

  1. In respect of the statement (15 September response) that 'the Baby Box meets all aspects of the standard applicable to it [BS EN 1130-1:1997 Furniture. Cribs and cradles for domestic use]', please confirm which elements of the BS it conforms to. Please reference your response to the relevant sections or sub-sections (1 – 7) of Part 1 of the standard.

  2. A copy of all communications between the Scottish Government and its contractor that refer to BS EN 1130-1:1997 explicitly or safety generally (of the box itself, not the contents), to include references in any contract, letters, e-mails, minutes or notes of meetings, and notes of conversations.

2. I have attached emails as requested with redactions covered by exemption under section 33(1) (b)of FOISA. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 33(1)(b) (Commercial Interests of FOISA applies to that information. The reasons why that exemption(s) applies are explained below.

Reasons for not providing information

An exemption(s) under section(s) 33(1)(b) of FOISA applies to some of the information you have requested. Disclosure would (or would be likely to) prejudice substantially the commercial interests of any person or organisation.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption. I have attached emails as requested with redactions covered by exemption under section 33(1) (b)of FOISA. This commercial exemption applies as the manufacturer of Scotland's Baby Box has Intellectual Property Rights(IP) over the design of the Baby Box which are commercially sensitive. Releasing this information would compromise the manufacturers IP.
