Information request and response under the Environmental Information (Scotland) Regulations 2004.

FOI reference: FOI/17/02755
Date received: 10 November 2017
Date responded: 15 December 2017

Information requested

Salmon mortalities reported to the Scottish Government which have been associated with hydrogen peroxide treatment since the reporting criteria were included in the industry Code of Good Practice for Finfish Aquaculture.

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

I enclose a copy of most of the information you requested. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you.

Some of the information you have requested has been published through our responses to other FoI requests:- /publications/foi-17-02089/

The above link provides information up until 18 September. I have provided an additional spread sheet containing all of the information you requested from 18 September to the date of your request.

Background Information

The information provided in this spreadsheet relates to mortality events which have been reported to the Marine Scotland Science. Whilst treatment and hydrogen peroxide may be specified as contributing causes to mortality, there may be other reasons and contributing factors behind the mortality.
