Information request and response under the Freedom of Information (Scotland) Act 2002.

FOI reference: FOI/18/00049
Date received: 3 January 2018
Date responded: 27 February 2018

Information requested

  • Minutes and agendas for every meeting of the Joint Programme Board (JPB) to integrate the British Transport Police (BTP) in Scotland into Police Scotland.

  • Any estimation made by the Scottish Government and/or the JPB of the costs of setting up a segregated pension fund(s) for current British Transport Police officers and staff who transfer into Police Scotland

  • What decision the Scottish Government and/or JPB have made as to which disciplinary policies will apply to current BTP officers after they have transferred to Police Scotland, any legal advice that has been received on this and any briefing material provided to Scottish ministers or the JPB on this topic.

Response

I enclose a copy of some of the information you have requested.

JPB minutes and agendas for the first JPB to the 9th JPB are available at:

/publications/foi-17-01179/

The remaining JPB minutes and agendas are available at:

http://www.gov.scot/Topics/Justice/policies/police-fire-rescue/police-scotland/BTP/jpbprogramme/proactiverelease

In terms of your second query, Paper 7.2, BTP Integration Update, from the Scottish Police Authority Public Board meeting on 19 December may be of interest to you. Pension costs are addressed at section 2.10, and the paper can be found at:

http://www.spa.police.uk/meetings-events/board-meetings/368532/382854/

I have also attached a number of extracts from relevant documents in response to your second query.

In respect of your third query, the Joint Programme Board workforce project is looking at terms and conditions as a whole and detailed work on which disciplinary policies will apply to BTP officers will form part of that. The JPB is approaching terms and conditions on the basis that BTP officers in Scotland will transfer with their existing terms and conditions, but no specific or separate decision has been made by the JPB regarding disciplinary arrangements, and there are no documents or information that fall within the scope of your request. Any decision of the Joint Programme Board will be recorded in the future publication of Joint Programme Board minutes.

In respect of your first and second query, under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you as detailed on the website links above. If, however, you do not have internet access to obtain this information from the websites listed, then please contact me again and I will send you a paper copy.
