Contractors for main routes in East Kilbride area: EIR release

Information requested

'I continually have difficulty having contractors for main routes in the East Kilbride area respond to complaints.

To assist me I would ask you for a map of the routes you have contracted out and information on the individual contractors. I would also request that you supply me with a record of the specification for repairs /maintenance of the roads involved .I am aware that certain information may be commercially confidential but am sure that the specifications for the contract will not be affected by this.'

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

For clarification, the following sections of road are maintained by Scotland Transerv who act on behalf of Transport Scotland;

  • A726 from Birniehill Roundabout to West Mains Roundabout
  • A725 from Birniehill Roundabout to Whirlies Roundabout (Kingsway) and to Bothwell Bridge

Scotland Transerv is instructed under the 4th Generation Term Contract for management and maintenance of the Scottish Trunk Road Network. Below is a link to the contract which details the requirements for repairs / maintenance:

The following sections of road are maintained by Connect Roads who also act on behalf of Transport Scotland under the M77 DBFO contract.

  • A726 Queensway between West Mains Roundabout and Philipshill Roundabout.
  • A726 Glasgow Southern Orbital.
  • A727 South Road between Philipshill Roundabout and Carmunnock Roundabout.
