1. Under the Railways Act 1993 (1993 c.43) and Railways Act 2005 (2005 c.14)) the Scottish Ministers have certain functions as franchising authority in relation to services provided under a Scottish franchise agreement. They are also responsible for funding and specifying the rail network, and for setting the long-term vision for rail in Scotland.

2. The SPA is not responsible for scrutiny of the policing of the railways or site-specific policing of nuclear establishments and MoD land.

3. The current regulations relating to the appointment and terms and conditions of service for all Police Scotland officers are set out in the Police Service of Scotland Regulations 2013, made under s.48 of the Police and Fire Reform (Scotland) Act 2012.
