Information request and response under the Environmental Information (Scotland) Regulations 2004


Information requested

All correspondence between the Scottish Government and the Scottish Fire and Rescue Service regarding Lancefield Quay estate, Glasgow. 1 January 2018 to present.

Response

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

While our aim is to provide information whenever possible, in this instance we are unable to provide all of the information you have requested because exceptions apply under

  • Regulation 10(5)(d) - Confidentiality of proceedings -Applies to information about the proceedings of a public authority where the proceedings are considered to be confidential.
  • Regulation 10(4)(e) (internal communications)

The reasons why exceptions apply are explained in the Annex A.

REASONS FOR NOT PROVIDING INFORMATION

An exception applies - Regulation 10(4)(e) (internal communications)

An exception under regulation 10(4)(e) (internal communications) has been applied to the EIR request to all of the information you have requested.

Regulation 10(4)(e) allows authorities to refuse to disclose internal communications. This is a class-based exception, meaning that there is no need to consider whether disclosure of the communication would cause harm before applying the exception. Provided the information is an internal communication, the exception will apply.

This exception is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception.

An exception under regulation 10(5)(d) - Confidentiality of proceedings) has been applied to the EIR request to the information you have requested.

Regulation 10(5)(d) - Confidentiality of proceedings - Applies to information about the proceedings of a public authority where the proceedings are considered to be confidential. Applies where disclosure would harm the confidentiality of the proceedings of any public authority where such confidentiality is provided for by law.
