Any records you may hold which show or tend to show the extent or details of any areas under our client's ownership to which either [named person], the late [named person] or the farming partnership of [named farm] have claimed to have farmed or otherwise been in occupation of over the years.

Response

Further to my letter of 17 August 2017, I have now completed my review of our response to your request under the Environmental Information (Scotland) Regulations 2004 (EIRs) for any records which may show or tend to show the extent or details of any areas under your client's ownership to which either [named person], the late [named person] or the farming partnership of [named farm] have claimed to have farmed or otherwise been in occupation of over the years. I apologise for the delay in responding to your review request.

I have noted the points in your review request dated 8 August 2017 and that you have limited the scope of your request to information held on the area of land relative to [named person]. I have concluded that a different decision should be substituted and that it is possible to provide the following information.

The Principal Agricultural Officer for Highland Area has confirmed that (see attached map) –

  1. The land parcel NH/77050/31928 (which comprises the element shown hatched on your map supplied 20 July) has been claimed for subsidy under the Common Agricultural Policy in the years 2005 to 2017. He is unable to establish the position prior to 2005. This land has been claimed as total field area of 713.51 hectares or thereby.

  2. The land parcel NH/74944/31440 has been claimed for subsidy under the Common Agricultural Policy in the years 2005 to 2007. He is unable to establish the position prior to 2005. This land has been claimed as total field area of 552.93 hectares or thereby.

  3. The land parcel NH/77146/29332 previously NH/77295/29128 has been claimed for subsidy under the Common Agricultural Policy in the years 2005 to 2017. He is unable to establish the position prior to 2005. This land has been claimed as total field area of 1164.88 hectares or 1124.98 hectares or thereby.

  4. The land parcel NH/74944/31440 has been claimed for subsidy under the Common Agricultural Policy in the years 2008 to 2017. He is unable to establish the position prior to 2005. This land has been claimed as total field area of either 518.88 hectares or 518.58 hectares or 498.70 hectares or thereby.

An exception under regulation 11(2) of the EIRs (personal information) applies to all of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
