Published: 8 Dec 2017

Information request and response under the Freedom of Information (Scotland) Act 2002.

FOI reference: FOI/17/02682
Date received: 23 October 2017
Date responded: 16 November 2017

Information requested

A list of names of people earning £55,000 - £60,000 per annum or above and their salary information since 2011 / 12 financial year.

Response

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section s.38(1)(b) (personal information) of FOISA applies to that information. The reasons why that exemption(s) applies are explained below.

However some of the information is already available and I have attached below the appropriate links which I hope will help. The links will take you to our Annual Report and accounts for the years in question. The Annual Reports and Accounts contain the salary information of our directors.

Annual Report and Accounts year ending March 2017

Annual Report and Accounts year ending March 2016

Annual Report and Accounts year ending March 2015

Annual Report and Accounts year ending March 2014

Annual Report and Accounts year ending March 2013

Annual Report and Accounts year ending March 2012

Reasons for not providing information

An exemption applies, subject to the public interest test.

An exemption(s) under section(s) s.38(1)(b) (personal information) of FOISA applies to some of the information you have requested. Where disclosure of personal data would contravene a notice under section 10 of the DPA (right to prevent processing likely to cause damage or distress) (section 38(2)(a)(ii)).

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption.
