Budget allocated to A77 South of Ayrshire: EIR release

Information requested

'It is noted that Scotland TranServ are currently proposing to undertaken remedial works on the A77 as a result of the recent weather conditions. We are pleased that works will be undertaken at Kirkoswald; between Girvan and Stranraer; and north of Kirkoswald.

It may be the view of some that this level of deterioration has been caused by the lack of investment in the trunk road network and perhaps specifically on the A77.

In order to better informed, I would be grateful if you could provide the following information for the A77 South of Ayr for the past three years (2015/16; 2016/17 and 2017/18) in relation to the overall budget allocated to this section of road and also the specific schemes which have been carried out each year.'

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

We applied regulation 10(4)(a) of the EIRs to the first part of your request regarding the amount spent on the A77 South of Ayr. The reason why that exception applies is that these costs are part of a maintenance budget for the entire route and we are unable to breakdown by route area.

We are however able to give you information in relation to spend on road maintenance for the A77. Regulation 10(4)(a) has also been applied as we only have confirmed maintenance spend figures to 30 September 2017. Please refer to the table below;

In relation to the second part of your request, please refer to Annex A which is a list of the specific schemes which have been carried out each year for the A77. Please note this does not include routine cyclic maintenance activities.
