Thank you for your request which is a follow up of FOI/18/01692 for the following information:
“I would again like to request the following information ‘Under the general requirements of the Freedom of Information,
How the defect was brought to the attention of TranServ, i.e. highlighted during routine check of highlighted by road user following incident.
How the defect was categorized i.e. category 1, 2 or 3 etc.
Date of repair and details of the repair method.”

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations.  We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. 

This exemption is subject to the ‘public interest test’.  Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption.  We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes.  This is essentially a technical point and has no material effect on the outcome of your request.

In response to your request, the defect was reported by member of the public at 11:30 on 29 January. Subsequently, Scotland TranServ dispatched a crew who arrived on site at 12:00. They assessed the defect and it was categorised as Category Two. Category Two defects are those which do not impose an immediate danger to traffic and these are monitored and repaired as required. A temporary repair was carried out by the use of cold tar and the crew left site at 12:30. The final repair to the defect took place on 6 March where hot rolled asphalt was used.
