I request publication of the documents listed below (if any) held by the Scottish Ministers from the following aviation stakeholders:

  • Glasgow Prestwick Airport Limited or TS Prestwick Holdco Limited
  • Highlands and Islands Airports Limited
  • ASG Airports Holdings Limited, Glasgow Airport Limited or Aberdeen Airport Limited
  • Edinburgh Airport Limited
  • NATS Limited, NATS (En Route) plc or NATS (Services) Limited

Documents sought – all pertaining to the Onshore Wind Policy Statement 2022 (as published on 21 December 2022)

  • Consultation responses from all/any of the above aviation stakeholders to the Onshore Wind Policy Statement Refresh 2022 (consultation closed January 2022)
  • Any further representations or consultation responses by all/any of the above aviation stakeholders in connection to the Onshore Wind Policy Statement 2022 received by the Scottish Ministers prior to 21 December 2022
  • Notes held by the Scottish Ministers of any conversations between Scottish Government ministers or officials with all/any of the above aviation stakeholders pertaining to the content of the Onshore Wind Policy Statement 2022

Some of the information you have requested is available publicly from Citizen Space on the Scottish Government Website, including the following responses to the Onshore Wind Policy Statement Consultation 2021-2022.

Under regulation 6(1)(b) (information otherwise accessible) of the EIRs, we do not have to give you information which is already publicly available and easily accessible to you in another form or format. If, however, you do not have internet access to obtain this information from the website listed, then please contact me again and I will send you a paper copy.

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. This includes information related to the following parts of your request,

  • Any further representations or consultation responses by all/any of the above aviation stakeholders in connection to the Onshore Wind Policy Statement 2022 received by the Scottish Ministers prior to 21 December 2022
  • Notes held by the Scottish Ministers of any conversations between Scottish Government ministers or officials with all/any of the above aviation stakeholders pertaining to the content of the Onshore Wind Policy Statement 2022

Therefore we are refusing this part of your request under the exception at regulation 10(4)(a) (information not held) of the EIRs. The reasons why that exception applies are explained in the Annex below.

An exception applies – 10(4)(a) (information not held)

Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), the Scottish Government is not required to provide information which it does not have. The Scottish Government does not have the information you have requested because no relevant material was identified following robust searches of our internal records.
