Information requested

All emails, text messages, WhatsApp's, minutes and other forms of communications of/between Ministers, SPADs, civil servants and other Scottish Government officials regarding/referencing/discussing the court case known as The Scottish Ministers v The Scottish Information Commissioner (case reference number XA10/23) up to and including the 6th of December 2023.

Response

I enclose a copy of some of the information you have requested in Annex B to this letter.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section 30(c) (effective conduct of public affairs), section 36(1) (confidentiality) and sections 38(1)(a) and (b) (personal information) of FOISA applies to that information. The reasons why these exemptions apply are explained in Annex A to this letter
